Welcome to Betty. These Terms of Service ("Terms") govern your access to and use of Betty's website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services. We reserve the right to update or modify these Terms at any time, and your continued use of the Services constitutes acceptance of such changes.

To use our Services, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts

• Reside in a jurisdiction where prediction markets and betting are legal
• Provide accurate and complete registration information

By using the Services, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and may suspend or terminate your account if you do not meet these requirements.

Account Creation

To access certain features of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Immediately notify us of any unauthorized access or security breach
• Accept responsibility for all activities under your account

Identity Verification

We may require you to complete identity verification (KYC - Know Your Customer) before you can:

• Deposit or withdraw funds
• Place bets above certain thresholds
• Access premium features

You authorize us to verify your identity using third-party services and government databases. Failure to complete verification may result in account limitations.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. We recommend:

• Using a strong, unique password
• Enabling two-factor authentication
• Not sharing your account with others
• Logging out of shared or public devices

Your Content

You may create, post, or share content on the Services ("User Content"), including predictions, comments, and profile information. You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with the Services.

Content Standards

You agree that your User Content will not:

• Violate any applicable law or regulation
• Infringe on intellectual property rights of others
• Contain false, misleading, or defamatory information
• Include hate speech, harassment, or discriminatory content
• Contain malware, viruses, or harmful code
• Promote illegal activities or violence
• Include spam, unauthorized advertising, or solicitation

Monitoring and Enforcement

We reserve the right to review, monitor, and remove User Content that violates these Terms. However, we are not obligated to monitor all User Content and are not responsible for content posted by users.

Market Creation

Users may create prediction markets subject to our guidelines. Markets must:

• Have clear, objective resolution criteria
• Not involve illegal activities or harmful outcomes
• Include a specific resolution date or event
• Comply with all applicable laws and regulations

Placing Bets

When placing bets, you acknowledge that:

• All bets are final once confirmed
• Markets may be canceled or voided in certain circumstances
• Resolution decisions are made in good faith based on available evidence
• You are solely responsible for understanding the market terms
• Betting limits may apply to your account

Market Resolution

Markets are resolved based on predetermined criteria. In cases of ambiguity, we reserve the right to make final determinations. Users may appeal resolution decisions within 7 days of settlement.

Prohibited Markets

You may not create markets involving:

• Assassination or harm to individuals
• Illegal activities or outcomes
• Personal attacks or harassment
• Minors or protected classes
• Outcomes you can directly control or influence

Deposits and Withdrawals

You may deposit funds using approved payment methods. Withdrawals are subject to verification requirements and processing times. We reserve the right to:

• Set minimum and maximum deposit/withdrawal amounts
• Require additional verification for large transactions
• Delay or reject suspicious transactions
• Charge fees for certain payment methods

Platform Fees

We charge a service fee on winning bets, currently set at 2% of net winnings. Fees may change with 30 days' notice. Additional fees may apply for:

• Expedited withdrawals
• Currency conversion
• Premium features or subscriptions
• Third-party payment processing

Taxes

You are responsible for all applicable taxes on winnings. We may be required to report winnings to tax authorities and withhold taxes as required by law.

The Services and all content, features, and functionality (including but not limited to software, text, graphics, logos, and trademarks) are owned by Betty or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or decompile our software
• Create derivative works based on our Services
• Remove or alter copyright notices or watermarks

You agree not to:

• Use automated systems (bots) without authorization
• Manipulate markets or engage in market manipulation
• Collude with other users to gain unfair advantages
• Create multiple accounts to circumvent limitations
• Engage in money laundering or fraudulent activities
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Services
• Scrape, crawl, or harvest data from the Services
• Impersonate other users or entities
• Use the Services for any illegal purpose

Your Rights

You may terminate your account at any time by contacting us. Upon termination, you must withdraw all funds within 30 days. After this period, we may charge dormancy fees.

Our Rights

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• We are required to do so by law
• Your account poses a security risk
• You fail to complete required verification

Effect of Termination

Upon termination:

• Your right to use the Services immediately ceases
• We may delete your account and data
• Outstanding bets will be honored according to market terms
• You must settle all outstanding obligations
• Certain provisions of these Terms will survive termination

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy, reliability, or completeness of content
• Security of transmissions or data storage

You acknowledge that:

• Prediction markets involve risk and you may lose money
• Past performance does not guarantee future results
• We do not provide investment, financial, or legal advice
• You should only bet what you can afford to lose

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from your use of the Services shall not exceed the greater of:

• The amount you paid to us in the 12 months before the claim
• $100 USD

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

Informal Resolution

Before filing a claim, you agree to contact us at legal@betty.app to seek informal resolution of the dispute.

Arbitration Agreement

Any dispute arising from these Terms or your use of the Services will be resolved through binding arbitration, except that you may assert claims in small claims court if they qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision will be final and binding.

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and Betty.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, or government actions.
